General Terms and Conditions for purchases in the online store Biskvit-germany

 

§ 1 General, scope of the terms and conditions

The presentation of goods and services in our online store is not a legally binding offer, but an invitation to order.

1.1 All deliveries and services shall be provided exclusively on the basis of the following General Terms and Conditions (hereinafter "GTC") in the version valid at the time of the order.

1.2 The contractual partner is sole proprietor Roman Gerr (hereinafter "Seller").

1.3 Customer in the sense of these Terms and Conditions may be consumers (hereinafter "Customer"). Consumers in the sense of the Terms and Conditions are natural persons.

§ 2 Conclusion of the contract.

2.1 If you have found the desired product, you can view it in more detail without obligation by clicking on the product name or the product image. By clicking the button Add to cart you can put the item in the shopping cart. You can view the contents of the shopping cart without obligation at any time by clicking on the "Shopping Cart" button. You can remove the products from the shopping cart or change them by clicking the "X". If you wish to purchase the products in the shopping cart, click on the "Order" button on the "Shopping Cart" page.

In the course of the further ordering process you set up a customer account with us for your first purchase or continue without it and choose the shipping method as well as the payment method. In the last step you get under "Order" again an overview of your order data and can check all details again and specify your special wishes or comments under comments. You can also correct input errors by navigating backwards in the browser or canceling the ordering process and starting again. To complete the purchase, you must accept our terms and conditions and press the Buy Now button. This will send the order to us.

You can view the latest version of the General Terms and Conditions of Sale and Use at any time on this page.

We reserve the right, at our sole discretion, to update, modify or replace any part of these Terms of Sale and Use by posting updates and changes on our website. It is your responsibility to visit our website periodically to determine if any changes have been made. Your continued use of or access to our website following the posting of changes to these Terms of Sale and Use will constitute your acceptance of those changes.

§ 3 Storage of order data

We store your order and the order data entered. We will send you an order receipt and order confirmation with all order data by e-mail. After shipment, we will also send you a shipment confirmation by e-mail.

You will receive the invoice together with the delivery.

3.1 Storage of unpaid orders

An order placed by you that has not been paid immediately (example 'bank transfer' , 'prepayment'), or not shipped, will be stored for you for 3 calendar days from the date and time of your order. If the payment is not received within this period, we will cancel the order. The exception to this is the payment method - ''payment on account''.

§ 4 Right of withdrawal for consumers

The following right of revocation exists only for consumers in distance selling:

4.1 Cancellation policy

You have the right to revoke the goods (hereinafter contract) within 14 (fourteen) days without giving any reason.

The revocation period is 14 (fourteen) days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by providing the following information (name, address, telephone number and e-mail address).

 To comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the expiry of the revocation period.

Consequences of the revocation

If you revoke this contract, we must refund all payments we have received from you (with the exception of delivery costs/additional costs) immediately and at the latest within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment.

If we have to pay a commission or bank fee (e.g. PayPal fee) when returning the money, this fee will be borne by the buyer.

We may refuse to refund you until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any case no later than 14 (fourteen) days from the day on which you received the goods. The deadline is met if you send the goods before the expiry of the period of 14 (fourteen) days.

You shall bear the direct costs of returning the goods.

You must pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for testing the condition, properties and functioning of the goods.

4.2 Exclusion of the right of revocation

The right of withdrawal does not apply to the following contracts:

-Packaging is broken

-The product has been used

-The product is damaged

If at least one of above described conditions present, this is a reason for refusing a right of withdrawal.

§ 5 Prices and shipping costs

All prices listed on the website are final prices in euros, which apply when ordering via the Internet.

All prices are valid on the day of order. Prices are changed continuously - and often from day to day. If biskvit-germany.de accepts the order, the buyer will receive an invoice for the price valid on the day of the order. 

We reserve the right to offer seasonal, holiday, etc. discounts at the amounts and conditions set by ourselves, as well as individual discounts at our discretion.

We deliver with DHL or (in individual cases) another provider of our choice with insured shipping, liability up to 500 € and tracking. 

Shipping costs are regulated by us. 

§ 6 Terms of delivery

All orders outside of Germany are only possible with prepayment, Banking transfer or PayPal, and will be shipped out after 100% payment. 

6.1 We deliver all over the world. Please select a country when ordering. The shipping costs depend on the recipient country and the weight / size of the package.

6.2 Delivery costs within Germany are 4.99 Euro. 

6.3 Unless otherwise stated in the offer, the goods will be shipped within 2 business days. 

If we are unable to deliver the ordered goods - for example due to unforeseeable high demand or bottlenecks at suppliers - we will inform you immediately about a delay caused by this.

6.4 From a purchase of 80 euros, we deliver within Germany free of shipping costs.

6.5 Delivery to all EU countries possible by arrangement. However, this must be agreed in advance.

§ 7 Terms of payment

7.1 Payment shall be made either by PayPal, advance payment by bank transfer, credit card (VISA, Mastercard), by immediate bank transfer or by payment on account.

7.2 We reserve the right to exclude individual payment methods. For example, for payment on account from 150 euros, we reserve the right to require payment in advance or PayPal. 

7.3 We reserve the right to send a second unpaid order (ordered with payment method 'payment on account') only after we have received payment for the first order (ordered with payment method 'payment on account').

7.4 We retain title to the purchased item until the invoice amount has been paid in full.

7.5 We also reserve the right to ship the goods to customers who have defaulted on payment in the past only after full prepayment.

We use the transmission method "SSL" to encrypt your personal data.

§ 8 Warranty

If you are a consumer, the warranty is in accordance with the statutory provisions.

§ 9 Liability

We are liable without limitation according to the provisions of the Product Liability Act.

§ 11 Miscellaneous

11.1 The contract language is German.

11.2 The European Commission provides a platform for online dispute resolution (OS). This can be accessed via the following Internet address:

https://ec.europa.eu/consumers/odr/.

We are not willing or obliged to participate in a dispute resolution procedure of the consumer arbitration boards.

11.3 If one or more provisions of these GTC are invalid, the remainder of the contract shall remain valid. Insofar as the provisions are invalid, the content of the contract shall be governed by the statutory provisions.
